By accessing or using AiLevate’s platform and services, you agree to be bound by these Terms and Conditions. If you do not agree, you must stop using our platform immediately.

AiLevate provides AI-driven marketing automation services, including SMS marketing, email campaigns, automated phone calls, and CRM tools. We do not guarantee specific business outcomes, and the effectiveness of our services depends on user engagement and compliance with legal requirements.

3. Account Registration

To access certain features, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

4. User Responsibilities and Compliance

You agree to:

• Use our platform legally and ethically in compliance with Canadian and U.S. laws, including PIPEDA, CASL, TCPA, and GDPR (if applicable).
• Obtain explicit consent before sending marketing messages, including SMS, emails, and automated calls.
• Not use our platform for spam, fraudulent, deceptive, or illegal activities.
• Be responsible for all content and communications sent through our platform.

Violations may result in account suspension or termination without a refund.

5. Privacy Policy

By using our platform, you agree to our Privacy Policy, which outlines how we collect, use, and protect personal data. You are responsible for ensuring that your use of our platform complies with data protection laws in your jurisdiction.

6. Intellectual Property

8. Limitation of Liability

AiLevate shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform, including but not limited to lost revenue, data loss, or service interruptions. Our total liability is limited to the amount paid for our services in the last three (3) months.

9. Subscription Fees and Payments

• By subscribing to AiLevate’s services, you agree to pay the monthly subscription fee as outlined at the time of signup.
• Failure to pay will result in account suspension and possible termination.
• If you choose to pay in full to gain website ownership, this covers only design, development, and agreed-upon content.
• A monthly hosting fee is required to keep your website live, even after full payment for ownership.
• Late payments may incur reactivation fees to restore access to suspended accounts.

10. Refund and Cancellation Policy

30-Day Money-Back Guarantee: If you are not satisfied within the first 30 days, you may request a full refund. Refunds must be requested in writing within this timeframe.

After 30 days, no refunds will be issued, but you can cancel your subscription at any time. Services will remain active until the end of the current billing cycle.

Customers can cancel via their AiLevate dashboard or by contacting customer support.

11. Price Changes

AiLevate reserves the right to modify pricing. Customers will be notified in advance, and price changes will only apply to future billing cycles.

12. PCI Compliance and Secure Transactions

AiLevate complies with Payment Card Industry Data Security Standards (PCI DSS) to protect payment information. We accept major credit cards, bank transfers, and PayPal.

13. Policy Updates and Notifications

AiLevate may update these Terms and Conditions at any time. We will notify users via:

• Email notifications (if required by law)

Continued use of our platform after updates constitutes acceptance of the revised terms.

14. Governing Law

These Terms and Conditions are governed by the laws of Ontario, Canada. Any disputes shall be resolved in a competent court within Ontario.

You agree to indemnify, defend, and hold harmless AiLevate, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:

• Any content you submit or actions you take using our services.
• Any violation of these Terms & Conditions or applicable laws.

16. Force Majeure

AiLevate is not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:

• Natural disasters
• Government regulations
• Internet or telecommunications failures
• Cyberattacks or security breaches

17. No AI Misuse

Users may not use AiLevate’s AI-driven marketing services to generate, distribute, or promote:

• Spam or misleading advertising
• Content that violates intellectual property rights
• Any material that is illegal, fraudulent, or unethical
